Important information regarding your Synergy Design services

Synergy Design Cancelation Policy

Synergy Design prides itself for having a history of happy customers who have allowed us to provide their hosting and design services since 1999. While we do not expect you will need or want to cancel, we provide a very low stress method of cancelation if you need to turn off or move your website.

You may cancel anytime for any reason providing the following:

Refunds are only available for pre-paid months of hosting services with a 30 day notice.

Note: Hosting payment is due on the first day of each month for that month of service and pro-rated monthly fees are not refundable.

If you have paid in advance for services, you will receive a credit for unused months of service after 30 day notice, not including any free months for advance payment options.

Submission of cancellation request via email does not automatically complete the cancellation, you must verify your request has been received by Synergy Design management and follow up by phone or in person if you do not receive your cancellation reply email. Generally we will need to work together to provide a smooth transaction and close your account (i.e. Turning off services such as hosting and email).

If your account is past due or delinquent, the balance must be settled before cancellation of an account can be finalized.

Errors or delays in domain name registration or transfer, non-usage of the account, Internic problems, ISP problems, or any other secondary issues not directly provided by Synergy Design do not automatically qualify an account for cancellation. However we will work with you to help resolve any of these outside issues and otherwise allow you to cancel your account.

Notice: Cancellation of a hosting account will also cancel all additional services associated with the account, such as email, databases, web statistics, domain registrations, and domain pointers. Generally ecommerce shopping cart and PPC or other marketing services are billed and managed separately and are the clients responsibility to cancel through appropriate party. If you are unsure simply contact us for help.

Synergy Design is able to provide your domain name registration and renewal services if requested. When domain name registration is cancelled, the domain will be released back to domain pool or revert back to Synergy Design domain management account. We will continue to offer registration or transfer services to former and existing clients, upon request. Generally your domain name is registered in your business name and you retain ownership and administration responsibilities.

Please note: If no confirmation of cancellation is received, please contact management to verify that your request was processed. In the event that a dispute arises, an account will be considered active, unless otherwise notified. Please keep a record of your cancellation confirmation email for your records.

Our Billing Policies

Hosting services are billed on monthly, 6-month, or yearly cycles, depending on what hosting plan you have selected. If you are auto-billed monthly, your renewal fees may be collected as early as 5 days in advance from your renewal date. Hosting fees are due on the first day of the month for that month of service.

Payments
For credit card customers, you will be automatically charged the appropriate amount at the beginning of your account's billing period. For check customers, please mail your check by the beginning of your billing period.

Payments past 15 days of due date are subject to a late fee of $5 unless arrangements are made prior.

Late Payments Past 30 Days
Unless arrangements are made in advance, Synergy Design reserves the right to disable your website and email services until your balance is paid in full.

All other services, such as merchant accounts, ecommerce shopping carts, and hosting add-ons are paid in full prior to setup and non-refundable charges. Additionally, these services are often billed separately and by the associated 3rd party providing the service.

Overusage & Metered Bandwidth
Hosting accounts are often customized to the needs of your website and provide ample disc space and bandwidth needed to run the average business website. In some cases your site may receive larger amounts of traffic from marketing or PR or other sources and may run over the allotted amount of space or bandwidth available. If you expect your website to receive a larger than average amount of traffic at any given time, please contact us to make arrangements.

Note: Synergy Design hosting runs on the new cloud hosting environment which provides flexible bandwidth and it is not expected that your site should run out of bandwidth or need to be charged additional fees. In a rare event a small fee of $5/GB may be charged for single overage events. Otherwise you will be contacted about upgrading your account to the next available hosting option to accommodate your needs.

Service Fees

Synergy Design has never received a credit card “chargeback,” but in the event of chargebacks or returned checks a $25 fee will be charged.

Accounts which are suspended or deactivated will incur a nominal administrative charge of $25.00 prior to reactivation.

Additional Terms of Service

Pornography - Due to legal and social issues, we will not accept any customers who publish pornographic images. We do not allow any pornographic content on our server, including but not limited to nude photographs, explicit language, or sexual fiction. If an existing customer publishes pornographic images.

Note: No site that promotes Pornography or nudity will be allowed on our servers, this includes BANNERS, CLICKER SITES, EDITORIALS, STORIES, NUDE PHOTOGRAPHS, EXPLICIT LANGUAGE, SEXUAL FICTION, OR ANYTHING THAT SYNERGY DESIGN DEEMS INAPPROPRIATE FOR OUR SERVERS. If an existing customer publishes pornographic images, Synergy Design will remove your site from our server and all monies paid will be forfeited.


Strict No-SPAM or Bulk Email Policy

Bulk Email, Spam, or Unsolicited Mail Submissions -

NO DOMAIN MAINTAINED BY SYNERGY DESIGN will be permitted to submit BULK EMAIL of any type. This includes but not limited to using our Email server or any other BULK EMAIL submission service.

This includes but is not limited to the use of the Domain Name or an Email Address for the Domain Name in the actual Bulk Email. If we receive a complaint on a BULK EMAIL from a Domain maintained on our servers, the account will be subject to suspension and/or cancellation without notice.

Synergy Design does not allow the sending of unsolicited commercial e-mail or SPAM from its servers from our customers. In the event that a customer is found to have purposefully engaged in these manners, Synergy Design reserves the right to cancel hosting and email services for this client and institute a fine of up to $500.00 per unsolicited commercial e-mail or SPAM incident should the customers' account be suspended due to UCE/SPAM related issues. Additionally, Synergy Design may collect an administrative fee of up to $25.00 per unsolicited commercial e-mail or piece of SPAM being investigated.
